Before you agree to "no win, no fee"

New Zealand law calls this a conditional fee agreement: some or all of the lawyer's fees are payable only if your matter succeeds (Lawyers and Conveyancers Act 2006, s333).

Not available for every matter. The Act's protection does not extend to criminal proceedings, Immigration Act proceedings, or proceedings in the Family Court (s335).
The fee is a normal fee, or a normal fee plus a premium for the risk of not being paid. The premium cannot be calculated as a proportion of the amount recovered (s333, s334).
It must be in writing and set out how the fee is worked out, what counts as success, any fees or expenses you pay whether or not you succeed, how either side can end it, and when you might have to pay the other party's costs (Conduct and Client Care Rules, r9.10).
You can cancel within 5 working days of entering it; the lawyer may charge a normal fee for work done in that time (r9.10(g)).
Before you agree, the lawyer must tell you about other arrangements that may suit you, including legal aid where relevant, and the final fee must be fair and reasonable (r9.9).
At the end, the lawyer's account must show the normal fee and the premium separately (r9.11).

Employment advocates who are not lawyers are not bound by these rules and may charge differently; ask for any fee arrangement in writing.

No — most ACC claims are processed without a lawyer. Lawyers are used mainly when ACC declines cover, weekly compensation is disputed, or you need to appeal an ACC decision to the District Court.

Can I sue someone for personal injury in NZ? ▾

NZ's ACC scheme bars most personal-injury lawsuits in exchange for no-fault cover. Exceptions include exemplary damages, harm not covered by ACC, and certain workplace and motor-vehicle matters.
